Kubiliun & Associates, Case Highlights

Kubiliun & Associates, PA is a practice which focuses exclusively on Criminal Defense. The firm has a varied clientele with a wide range of charges from driving under the influence to first degree murder. Each case and each client is given the same unwavering commitment to zealous and thorough representation. Many of the cases that Kubiliun & Associates handle involve private individuals accused of crimes, not subjected to local or national press scrutiny. However, our experience and ability insure that the firm is well equipped to handle cases under the spotlight of the local or national press. The following paragraphs will highlight some examples of such "high profile" cases.

The firm of Kubiliun & Associates, PA was thrust into the international spotlight within months of its formation. Three Muslim medical students were detained along Florida's "Alligator Alley" directly following the first anniversary of the September 11 tragedy. They were detained on suspicion of terrorism solely on the basis of a Georgia woman's belief that she overheard them speaking of a plot to blow up a building in Miami. The three innocent young men had led upstanding and responsible lives, having no ties to terrorism or anti-American sentiment. In fact, all were United States citizens.

David Kubiliun was one of the three attorneys who represented these men in an effort to clear their names and prevent criminal charges from being filed. This effort led to discussion with the Florida and Georgia authorities. It also led to coverage in over one hundred periodicals and involvement in numerous national television programs and interviews including Larry King Live, Ultima Hora, The Today Show, Primer Impacto, CNN's Crossfire, Fox News Live with Linda Vesser, and the Donahue Show, to name a few.

These efforts resulted in the young men being allowed to continue with their medical education and no criminal charges of any kind being filed.

Subsequently, Kubiliun & Associates was referred, by a Human Rights Organization affiliated with the United Nations, to a Turkish Family whose son was under arrest in Tampa, Florida on false allegations. The firm secured his release within two weeks and ultimately tried the case in front of a jury which acquitted the young man of all charges.

In the summer of 2003, Kubiliun & Associates had the opportunity to represent Teresa Jimenez, a 21 year old Mexican girl held by Florida authorities and accused of abandoning her newborn baby on Bal Harbor Beach. Upon meeting the young woman, both attorneys were convinced of her innocence. The young lady's treating physician Dr. Cesare DiRocco told the firm, that without a doubt, Teresa was suffering from a medical condition which made it impossible for her to intend to have injured her child. The Mexican Consulate provided invaluable assistance to the firm by providing documentation regarding the father of the child in Mexico and working hand in hand with the attorney's throughout the case. This joint effort led to the child being united with his father in Mexico within two weeks of his birth. Kubiliun & Associates then began negotiations with the Miami State Attorney's Office ultimately resulting in no charges being filed against Teresa. She was released from jail and reunited in Mexico, with her infant son Isaac, within 45 days of her incarceration.

These highly publicized cases are merely examples of how a professional and competent approach to criminal defense can produce just results.
